آليات مكافحة الجرائم الأسرية في العراق القديم في ظل التشريعات القانونية القديمة

تُعرف الجريمة بأنها: "خطأ يرتكب ضد المجتمع أو ضد الدولة" (مونتاجيو، 1965) Montagu: 1965, ويمثل القانون: "التدابير أو الإجراءات التي يَتخذها من بيدهم السلطة حتى يجبروا الناس على التزام السلوك الذي يعُتَبر جوهرياً بالنسبة لاستقرار المجتمع" (مونتاجيو، 1965، صفحة 195) Montagu: 1965, ونعني بالأسرة: "مجموعة الاشخاص تربط بينهم رابطة القرابة أو المصاهرة" (دراغمة، 2011)Daraghmeh: 2011, وكان لاتساع المدن وتطور الاقتصادين الزراعي والتجاري أثره في تعقد الحياة الاجتماعية منذ تطور القرى الزراعية في الألفين السادس والخامس وصولاً إلى الألفين الثالث والثاني قبل الميلاد سبباً في نمو العادات والتقاليد لتصير اعرافاً سار عليها المجتمع ونظر باستهجان إلى كل من خرج عن هذه العادات والتقاليد (عبد الواحد و سليمان، 1979), وقد وردت ألفاظ دالة على فعل الجريمة والأسرة والعائلة في الكتابات المسمارية من ذلك الكتابات الدالة على لفظة اسرة أو بيت الآباء أو الأجداد (EAD/bít abi) (الجبوري، 2010)Al-Jubouri: 2010, ولفظة عائلة (emušutu) (سليمان و وآخرون، 1999)Suleiman: 1999, فيما جاءت عبارة يرتكب جرائم بالنحو الآتي ((Lemnu "Iemnéti" (الجبوري، 2010، صفحة 132)Al-Jubouri: 2010, وظاهرة الجرائم الأسرية تُعد واحدة من المخرجات التي انتشرت في مختلف المجتمعات وباتت تهدد كيان الاسرة وامن المجتمع ويجيء انتشارها إلى اسباب من بينها الفقر والبطالة والجهل وعدم الركون إلى الحوار بين أفراد الأسرة واتساع ظاهرة تعاطي المخدرات والعنف بأشكاله النفسية والجسدية والجنسية وتداعي القيم المجتمعية نتيجة عوامل اجتماعية واقتصادية ومن هذه الجرائم ما كان منها موجهاً ضد الأطفال أو الأقارب أو بين الأزواج فكان أن توجب على المشرعين القانونيين إيجاد السبل الكفيلة لحماية الأسرة ومنع تفكك هذه اللبنة الأساسية في بناء المجتمع (ديش، 2019)Dish: 2019.
وهذا البحث "آليات مكافحة الجرائم الأسرية في العراق القديم في ظل التشريعات القانونية القديمة" يسلط الضوء على الآليات التي اتبعت في العراق القديم لمكافحة الجريمة قانونياً؛ إذ ارادت جميع القوانين العراقية القديمة([i]) ان تكسب علاقات البشر المختلفة الاجتماعية والاقتصادية صفة قانونية (ايمار و اوبوايه، 1964)Aymar and Oboye: 1964, وقد توصل البحث إلى إن القوانين العراقية القديمة قد تضمنت مواده معالجات لمكافحة هذه الجرائم.
