جاءت الشريعة الإسلامية وأحكامها التي تتماشى مع مصالح الناس في كل زمان ومكان عن طريق القواعد الإجمالية أو الأحكام الجزئية التفصيلية، ولذا كان من أهم الواجبات معرفة هذا الشرع الحكيم والتفقه فيه، وذلك مهم لبيان الاحكام الشرعية فيما أستجد من المسائل والوقائع بعرضها على الأدلة الإجمالية والقواعد الفقهية او الحاقها بما يشابهها مما نص عليه العلماء رحمهم الله، والناظر فيما استجد من المسائل الطبية يجد ان كثيراً منها لم يرد نص شرعي في بيان حكمها، فلذا وجب على علماء الفقه ان يبينوا الحكم في تلك المسائل، وذلك بالنظر في القواعد الفقهية التي تنطبق على المسائل الطبية وهذه القواعد الفقهية تشهد على مدى صلاحية الشريعة الاسلامية لكل زمان ومكان، وهي ايضاً تضع بعض القيود على الاعمال الطبية حتى لا تخرج عن الهدف الأسمى من إباحة التداوي، والتعرض للبدن الانساني مع كرامته، لذا جاء بحثي الموسوم (المستجدات الطبية المندرجة تحت قاعدة لا ضرر ولا ضرار) ومن هنا تبرز اهمية الموضوع حيث ان قاعدة لا ضرر ولا ضرار تعتبر من القواعد الفقهية الكبرى ومن المهم الربط بين القواعد الفقهية والمسائل الطبية وخاصة المسائل التي استجدت في هذا العصر.
